AIFF vs FIFA: Supreme Court Orders new AIFF body to be formed – The Supreme Court on the third hearing of the case of the All India Football Federation (AIFF) suggested that the general body of AIFF should be formed. This new body will be formed by the 36 state associations and 36 players and this executive body s needed to be formed by September. Today’s Order from the Supreme Court read, “FIFA said inaugural function must be carried out under a democratically elected AIFF. This prompted the court to have ready a constitution and facilitate holding of elections. During course of previous hearing on July 28, there was a general consensus that the court should issue specific directions. But all Objections would need to be heard.”

“Issue has been raised that polls should be delayed any further. We have been conveyed they they should be conducted in consonance with the natl sports code and draft Constitution.”

As per the guidelines set by FIFA, the apex governing body of a footballing nation should consist of democratically elected members. Therefore this measure has been directed by the Supreme Court. The Constitutional matters and procedures are to be dealt later after the World Cup concludes.

It should be noted that this is an interim affair to allow India to host the World Cup without breaking any rules. Accepting the plan proposed by the CoA, the bench of justices Dhananjaya Y Chandrachud and JB Pardiwala said, “The present body of AIFF will continue for three months. They cannot claim any equities and will be subject to further orders so that the Constitution can be finalised in the meantime.”

The bench said, “Consistent with the need of sport of football in India, sportspersons who represented the country will be of immense benefit for the development of sport in a healthy manner.”

The Committee of Administrators (CoA) who submitted the draft AIFF constitution to the Supreme Court. Today’s order read “CoA received 215 comments including objections by State Associations. 98% of the objections were accepted. In earlier order of this court, notice has been taken of the fact that the FIFA U-17 Women’s World Cup is due to commence with India to host.”

The order further read, “For the purpose of the voting, the electoral college will comprise state associations and eminent players. There are 36 State associations who’d nominate one eminent player to represent them, 1 vote each. Inclusion of prominent sportspersons is envisaged with tenure limits and minimum 25% membership. Sportspersons may be chosen by consultation with Sports Ministry.”

“1) elections to executive commitee of AIFF be held expeditiously. 2) elections shall be conducted in a manner consistent with article 26 of draft constitution. This would be an interim arrangement without prejudicing the rights of all parties. The interim body would hold office for three months till the constitution is adopted. Interim body cannot claim equity on basis of this order and be subject to further orders.”
