Novak Djokovic faces deportation from Australia after a Federal Court unanimously ruled to overturn his application to have his visa cancellation overturned, dismissed with costs.
Full written reasons are to be published at a later date.
Djokovic’s lawyers had unsuccessfully argued Immigration Minister Alex Hawke’s decision to cancel the visa on Friday was “illogical, irrational and unreasonable”.

Meanwhile the Australian Open order of play for Monday has been announced, Djokovic scheduled to play Monday night — and as per the LATEST VERDICT he will not able to play in AO2022

  • Novak Djokovic, if he plays, will be last on Rod Laver Arena, playing at about 21:00 local time (10:00 GMT) on the show-court.
  • That would give the defending men’s champion as much time as possible to recover – mentally and physically – after today’s hearing if it is successful.
  • Djokovic is set to play fellow Serb Miomir Kecmanovic.

Djokovic VISA Hearing LIVE: Court adjourns and will ‘indicate course later’

Chief Justice Allsop says the court will adjourn to consider the legal arguments:

“We hope to be in a position to identify to parties later this afternoon what the course is we propose, and may well come back this afternoon or tomorrow morning to deal with matter in the best way we can,” he says.

Stephen Lloyd SC, representing the Immigration Minister Alex Hawke, has concluded his arguments.

Lloyd said it was “common sense and uncontroversial” to assume that people would listen to Djokovic’s views, given what we know about the power of celebrity.

DJOKOVIC SUBMISSIONS – The grounds presented by Djokovic’s lawyers are as follows:

Ground One: The government failed to consider the consequences of cancelling his visa.
Ground Two: Not open to the minister to be satisfied the presence of Mr Djokovic “is or may be” a relevant risk.
Ground Three: “Unreasonableness and irrationality” in regard to Mr Djokovic’s vaccination stance

Djokovic’s court hearing is adjourned for one hour – The court hearing Novak Djokovic’s case against Australian Immigration Minister Alex Hawke has adjourned for an hour until 1:30 p.m. AEDT (9:30 p.m. ET).

  • Before the break, lawyer Stephen Lloyd, acting for Hawke, estimated it would take him another hour to finish arguing the government’s case.
  • Three judges are hearing Djokovic’s appeal against Hawke’s decision to cancel the tennis star’s visa. They hope to make a decision Sunday before the Australian Open tennis tournament kicks off Monday.

Barrister Stephen Lloyd is providing evidence for why Immigration Minister Alex Hawke characterised Djokovic as anti-vax and galvanising to anti-vax communities.

He says that Djokovic is still unvaccinated in 2022 is representative enough of the tennis player’s views.

“It’s open to infer that a person in the applicant’s position could have been vaccinated if he wanted to be,” Lloyd says.

He argues it doesn’t actually matter what Djokovic’s views on vaccines actually are in this case when the government is assessing “risk”. Wood says it’s the perception of the person – if the public thinks he’s an anti-vax figure.

Immigration Minister Alex Hawke has argued – citing s116 of the Migration Act – that Djokovic’s visa should be cancelled because his continued presence in Australia presents a risk to the “health” and “good order” of the Australian community.

He has also found that cancelling the visa would be in “the public interest” – the second condition that needs to be met.

  • The government argues that Djokovic presents a health risk because he’s made anti-vax statements before and this could lead to an increase in anti-vax behaviour. Over 90% of Australian adults are double vaccinated, but the government argues Djokovic’s influence could stop people from getting boosters

Mr Wood says Djokovic is just here to play tennis, and the government has accepted that he entered on a valid exemption. So this idea that he’s fostered anti-vaccine sentiment is “irrational” and “illogical”, he says.

Djokovic VISA Issue LIVE:  Djokovic was due to hand himself into immigration officers for detention on Saturday and required to surrender to officials in Melbourne for an interview, according to a court order issued on Friday night.

The Serb has been detained and is now set for a Federal Court showdown on Sunday and it will look very different to what was once expected.

What is the case against him? While much of the controversy surrounding Djokovic’s arrival into Australia was based on whether he had a valid medical exemption, that is not the case anymore.

A report from The Age on Saturday morning revealed a different stance on the whole debate from Immigration Minister Alex Hawke.

The report revealed Hawke’s decision to cancel Djokovic’s visa for a second time centred around him being a risk to civil order and public health.

In it, Hawke conceded Djokovic had in fact entered Australia with a valid medical exemption and posed a low risk of contracting the virus and passing it on to others due to his recent infection.

Will the Australian Open Draws be changed? With the major due to begin in three days, the decision by Federal Immigration Minister Alex Hawke has engulfed the tournament in uncertainty.

Under provisions spelt out in the ITF grand slam rule book, the Australian Open can reshuffle the draw should a withdrawal occur before 11am on Saturday.

This would promote fifth seed Andrey Rublev to the top position on the draw sheet, with the Russian to play against fellow Serbian Miomir Kecmanovic.
